Maybe the 60 Minutes story from a few months ago is making a difference. DHS finally agreed today to show some humanity and not proceed for two year with deporting widows and widowers of US citizens (often American soldiers who die in combat) who only were denied green cards because their spouses died before USCIS could finish processing their cases. The courts have not been consistent in their rulings and it is going to take the US Supreme Court settling the matter (or DHS backing down). Hopefully, this marks the end of USCIS' rabid pursuit of a population that deserves...

Hello forum participants.
I am a dependent on an I-485 application, with my father being the primary applicant. The application has been pending since 2001, so I decided to first threaten USCIS with a lawsuit, and then maybe file a writ of mandamus. My question is whether I have authority to do so as a dependent. Can I represent the whole family or at least myself? My father is leaving the country for some time and it will be hard for him to participate in the process.

Hi Friends,
I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.
It'll really helpful to decide based on the folks replies. Thanks alot for the help.

Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
Please let me know.

Any I-485 approvals from Nebraska.. for EB3-I in the month of Jan..
My finger printing was done in Sep-2007 .....took an Infopass and opened a SR .The IO officer @ infopass said that the finger printing has to be initiated from Nabraska...any body on the same boat

I am working on my H1B and on I-140 approved Stage. At the same time I have applied for I-485 as Derivative applicant on my wife's application and also got the Advanace Parol.
If I use the AP (obtained based on wife's application) will my H1B got invalidated? My intention is keep my H1B and to avoid the H1B stamping.

Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
