All the people I saw till are had their OWN labors so ...!!!

I think you can't apply more than six months in advance from the date your H1 is expiring.
I guess anytime August onwards should be good .

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

I have been working with company A since december 2005 on my OPT.
Company A filed for my H1 that was approved and the start date for this
visa is december 1st 2006 (OPT expires december 15th, 2006). I am
talking to company B that wants me to join in november but is not sure
if they can file for a transfer before my visa begins. I have looked
around in various forums but havent found a satisfactory answer.
I have pay stubs from company A but, of course, they would be dated from
before the beginning of my visa. Can I use these for my transfer
application? Is transfer even possible in my case?

I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.
My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.
Is it OK if I accept this position with double salary?

My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

Anybody filed Un Signed Labor Substitution?
Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.
Any experince any body has, I request you to share that here.
Chance of denial or rejection is very high if the Labor substitue application is not signed by the applicant.

I mean what happens after FP?
Do they work with your application only when the PD is current?
or they work on the application regardless of PD?

Folks,
I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).
The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.
Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?
Please do advise. Thanks!

I am student on OPT extn working for an Non Profit Organisation ( non everified) , Since 2 months, I Know i should not work for non everfied company on OPT Extension, So i asked my company to do H1 asap, since workiing for non everified aslso considered as unemployed, But i am aware that in entire OPT we can unemployed for total 120 days.
My company is an Non Profit Organisation & dont have relatioship with any educational institues or research org.
Is my company eligible for H1 cap exempt, so that i can keep my start date as approval of H1? so i wont fall out of status since my H1 starts as the days of approval............or I need to wait until oct 1, 2010,
Even if i start at oct 1,2010, Will it affect my green card processing, since I worked for non everified around 6 months...........

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.
Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?
I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..
