Trying to use my EB3 date in the EB2 category


Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"

I asked her whats the next step after this?
IO : Hope fully will be assigne to some one

I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.

Any body who has thier case in the pool of "Pending review and final decision".

Honestly, I think its just a general status that she told me about my 485 case.

Friends,

In preparation to file I485, we just had medical tests and the doctor checked the box " Applicant does not meet immunization requirements" in my son's report citing the reason insufficient dates.

What is the impact of this ? How this can be remediated ? Any suggestions by those who experienced similar situation would be greatly appreciated.

I sent my 485 to NSC in July 2007 and got the receipt from NSC after 2 months. I filed my wifes 485 in first week of August 2007 to NSC but got the receipt from TSC. We live in Texas but our employer was from NJ when i applied 485. After that we have been applying for EAD and AP regulary at respective service centers with out any issues.

1. Has any one been in this situation and got their GC approved?
2. Do i need to request my wife's application to be moved to NSC if that can be done?

I am few days short of getting current and hope this doesn't delay approving our cases.

Yes you should furnish this info. One of the forms asks for details of previous marriages which you should provide. I think you will also need to provide your divorce decree. Providing the information does not impact your application one way or the other.

Hello everyone,

This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -

1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?

2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.

3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

I am a Canadian in the "Approved I-140, waiting for 485 Limbo" status. I have a prority date of March, 2004. I find IV a good source of both information and encouragement and I would like to know there are others near me who feel the same. Hope to hear from you soon?

My attorneys screwed up and filed my I140 under the wrong category. (EB3 instead of EB2). They refiled PP but without the original Labor cert attached. My PP application is not approved yet.

I called a couple of weeks ago and they told me they wont do PP because the original labor cert was not attached.

I Emailed them yesterday and this is their reply:

'This petition has been assigned to an officer,but no decision has been made.'

Does this mean anything? meaning is it close to being approved??

Once Super Bowls and major conventions start to go elsewhere (as was the case two decades ago when a similar boycott was successfully used to protest the state's failure to recognize the Martin Luther King holiday), the cavalier anti-immigrant positions will become a lot more expensive. Now that the I-485 gates have been opened, I would like to know what will happen to my spouse's H1B application pending before USCIS? Since I am planning on filing for I-485 for my spouse as well, will the H1B process make a difference? Or will the H1B approval cause any issues to the I-485 application?

Please help!

I don't think so. One of my friend is in same situation. I feel 485 is filed after H1b so every thing is fine. But on which boat they need to travel is the question? you can't use H1 if you use EAD?

Whiting, the court overruled a motion to dismiss the case challenging the law.
