I came in 2003 on an H4 visa with my parents who were on H1B, I was 17 yrs old at that time. I then got my status changed to an F1 in 2004. I completed my bachelors and have been accepted into a masters program on a scholarship. I wanted to visit India, however I would like to know the risk involved in doing so. Would I still be at risk of not getting a f1 VISA in India even if I carry my approved F1 petition? Please advise..Thanks..

I didnot receive my EAD yet, the online status says that Approval notice was mailed on Oct. 1st.
I would like to know if anyone is facing the same issue.
Can anyone let me know how should i proceed in this regard?

Hi,
I'm trying to bend text into a circle. I want the text to be standing up and then to spin the camera around the outside of the text.
Is there anyway I can bend the text in swift 3d into a circle or do I need to produce each letter seperately and then rotate and position?
Or, can I import the bent (circular) text from another application then 3d ify it in swift 2.0 ?

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?
Given a situation, one way to dust a file is to send the medical with a cover letter.

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. hi attorneys,
my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.
my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.
now my spouse wants to travel abroad for a family function.
questions:
(1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)
(2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Hi All,
My wife is on her first year of OPT, she is masters in STEM so she is eligible for 17 month extension.
In-order to re-new her OPT she needs get herself e-verified. However, her employer said thay they are not registered for e-verify system.
My question is �
- Is it possible to renew OPT without e-verification, if yes how?
- What are options in that case if her employer does not e-verify?

I am a doctoral student in clinical psychology, graduating next year in May or October. I am currently on an F-1 student visa and have heard ominous things about getting an H1-b and GC in my field.
I know I have time and things can change, but it seems like they are becoming more difficult. Hence if there are people out there who have ideas, experiences and information to share about what the process is like for potential psychologists to get sponsored, I would greatly appreciate your reply.

It has to be receipt date FIFO, but can never say how USCIS will processes.
With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.
Please let me know if 140 processing times is based on receipt date or notice date?
I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

It means Advance Parole. You will be eligible to apply for AP if your application for adjustment of status is pending with USCIS, and you need this document to re enter the US from overseas travel.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.
