Hi,
I apologize if I am asking a repeat question.
I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

New/amended 140, if the LC states correct job requirements (assuming the mistake was made on 140 application).
New LC if old LC states incorrect job requirements.
I have a Masters Degree in the US and the 5 yr experience required for the EB2 also the position requires it; however my lawyer made a mistake and asked for an EB3.
I already received my I-140 and my I-485 was filed at the same time.
What can I do to change to EB2?

Dear experts/Attorneys,
Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.

I am applying for an H-1B extension. The prevailing wage determined by icert is less than my actual salary by about $30,000. Will there be a problem if my salary is much higher than the prevailing wage?

I know this one guy has done this he worked on h1 for 6 years after that he didnt get extension so he changed his status to f1 as full time student ...now he is on f1 visa...so dont worry.

Can we go to USCIS office after 90 days of filing I-485 to get EAD? Also, does the 90 day counter starts once we file or when we get the receipt from USCIS. Please advice!

Guys, I am efiling 765 for EAD renewal. last year, my lawyer filed 765 and sent a G-28 along with that. This time, I am efiling on my own, do I need to send the G-28 ?
also, please let me know if photos are required to sent after efiling 765.
my AP is expiring sometime in mid Oct and EAD is expring on 30 Sep. I am efiling EAD on 30th of May, can I do the same for AP though, it will still be more that 120 remaining for AP?

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?
