Greetings,
I applied for a green card via a relative application on April 28th of 2001. I am under the 245I law. It has been 10 years since the application and it has been approved. A lawyer told me I have one more year to wait since they are still working on the visas from April of 2001. My question is: What month are they on currently and is there any way I can speed up this process? Is there a website where I can keep track of where the visas are?

As of August 14, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. We will keep you posted with any changes in this area.

President Barack Obama will gather congressional leaders at the White House next month to launch a policy discussion on immigration, according to an administration official, but legislative action isn't likely until next year at the earliest. he June 8 meeting is meant to show the White House is moving on the issue -- which is key for Hispanic advocacy groups that helped Mr. Obama get elected in November.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

Yes, you can apply for H-4 despite the fact that she has an H1 petition approved. It is difficult for me to comment on her H-4 rejection chances as I am not familiar with your cases, but generally if you are on valid H-1 status then you should not have problems.

EB3 is not moving because there are way too many people in it. Spillover or no spillover there will still be 140K visas per year and with 7% country limit, Indians can forget our greencard. Country limits is a very bad thing for us.

Scenario:
I have two Approved I-140s (both filed by same company).
� Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
� Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?

Hi Folks,
I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

Recently my 140 was filed and the checks were cashed through ACH. I paid for PP and see that the checks were cashed on March 8th. My attorney has not received my receipt, I was wondering if there was anyway I can get the receipt number for the case so I can track it ...
