So far, the USCIS has announced that it received 5,900 H-1B applications for the normal quota and an additional 4,500 for the advanced degree quota. These numbers were released yesterday, April 7, 2011.
In years past, many remember that the H-1B quota was exhausted as early as the first day of applications. Last year, the H-1B cap was not reached until January the following year. I would anticipate that with the economy still rebounding, the H-1B quota will last a significant amount of time. This will also ensure that everyone who can find a job offer this year will have a chance to make an H-1B application. One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

Many of us have had a positive reaction to the TB skin test. So we take an X-ray to confirm we are fine and the doctor mark normal in the chest X-ray section. Pretty routinely done.
Now my spouse had a negative TB skin test, so no X-ray needed. However the physician and my attorney have different views on how to fill out the chest X-ray section of the form. The physician checked nothing in the section and is very adamant about the way he fills out the form. My attorney believes that the NOT DONE box in the section should be checked as he claims that he has seen REFs if the NOT DONE box is not checked. What is your opinion? Appreciate your feedback. Thanks.

I have my H1 visa interview in Vancouver, Canada on the 21st of Nov. I'll be driving from Hillsboro (OR) to Vancouver on the 20th evening. I also have hotel reservation very close to the US embassy.
I was wondering if anyone who has an interview on the same day might be interested in sharing the ride and/or hotel expenses. Since the 22nd is a holiday, and I need to stay back for another day to get the visa, I have the hotel room booked from the 20th through the 23rd.
Please let me know if you are interested, we'll discuss further.

How funny is this? My PERM was filed for Tech lead position and I am getting enquiries for PM position and I can not take it whereas you are trying togo in reverse direction. Anyways... you can not come in reverse direction now. The SOC code for Tech Lead is '"15-1031 Software Applications Engineer" which is definitely different than Computer Systems Manager and I believe logically management stream is altogether different than technical stream. Be very careful and refer to attorney at law before you make the decision.

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.
Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?
Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?

I work for company A which sponsored my L1B (my current visa status). Also, few years back company B sponsored my H1B which for some reason I did not utilize (did not even get it stamped) and hence company B cancelled it. Now my questions are -
1. Can L1-B be transferred to H1-B without going through a new visa application?
2. Can the cancelled H1-B be re-instated and utilized?
3. If another company C applies for my H1-B what are the chances of getting it looking at the current work visa regulations and prospective changes? Will my past petition of H1-B cause some issues with consulate?
4. My wife is on L2 and as EAD. Once I file for change of status will the EAD still be valid or it will automatically be void?
Please Help...

I applied for H -1 extension regular processing in the month of sept 2009 in california service centre before expiration date of my H1-B(2010 Jan 22).I got RFE on DEC 18th asking for client and contractual agreements between client and vendors and i got time til Jan 29th 2010 to reply back to RFE.As i was preparing to collect all the documents to respond to my RFE ,I also applied new H 1 from same existing employer before Jan22nd 2010 in Vermont service centre.I replied back to RFE on jan 27th 2010 with client letters and letters from 2 vendors.
I got my H 1-b extension approved from California service centre on Feb 18th 2010
My question is what if my new H1 filed in vermont service centre gets rejected.Will it cause any problems to the extension that was approved.I already got my h1-b extension approval notice from uscis on FEB 18th 2010.I have'nt heard anything about my new h1 b filed on jan 21 2010 in vermont service centre.Can i continue to work on my approved extension.
Please advice me

Hello,
I am on a H1B with company A. I've been offered a job with company B which is currently processing my H1 transfer paperwork. I had accepted the offer letter from company B and had submitted all my papers for H1B transfer.
The starting date in the company B is 20th Nov as per offer letter. Now I had decided to stay back with the company A (by 18th Nov) before joining the company B. Is there any issue by doing so?
