The third of three immigrants on the the Presidential Council of Advisors on Science and Technology is Professor Ahmed Zewail, the winner of the 1999 Nobel Prize in Chemistry. Dr. Zewail is a professor of Chemistry and Physics at Caltech and is the Director of Caltech's Physical Biology Center. Dr. Zewail describes his research as follows: [The Nobel Prize was awarded for] pioneering developments in femtoscience, which made it possible to observe atoms in motion, the transition states of molecular transformations. Senators John Kerry (D-MA), Richard Lugar (R-IN) and Mark Udall (D-CO) have reintroduced the start up visa bill now that the new Congress is in session. The bill would grant two-year visas to entrepreneurs if they secure $100,000 from qualified investors. After two years, the start up must have at least five employees and $500,000 invested. Democrats and Republicans have talked endlessly that the focus in Washington should be on job creation, but for the most part little has been done. The start up visa is a way to directly create jobs and costs the taxpayers nothing.

We have received our EAD cards without having Finger Print done. We have received FP notice and scheduled for the next week but received our EAD cards.
EAD cards says "No Finger print available" on the right corner. Will this cause any problems?

Please advice.

hi attorneys,

i am currently on H-1B with employer A. i hv a job offer from employer B which is a mgr role based outside USA.

i know that if i work for 1+ yr with employer B outside USA then i can come back to USA on L1-A visa.

my question is - during this 1 yr period, can i work for employer B in USA on H-1B?

Hello Guys,

I need urgent help please.
I am on 8th year of my H-1B, expiring on July-2008.
I am on EB3 Nebraska, PD 07/2003.
I-140 pending � RFE on Education (3 years degree) replied on December-2007
EAD approved on September-2007.
I485 aplied on july-2-2007

Just got an email from Cris that my I485 was denied. I don�t know the reason.
My I140 is still pending � almost 4 months after my attorney replied the I140 RFE.

Today I am writing this in order to understand my available options and strategy to this situation.
I have less than 2 months on H-1(b).

What are my options?
Anybody in the same situation?

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. What this means is that any person charged under the new law is entitled to a taxpayer funded public defender or taxpayer funded private lawyer. And we lawyers...

Hi,

I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.

In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.
