Hi Gurus,

I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.

Please let me know,

When you start using EAD you will lose H1 status. You can do multiple jobs on ead but not on H1

I guess that should be OK. Only H1B rules require one to be continuously earning. On EAD, if you have a potential employer who is willing to hire you after your GC is approved, you can remain without regular paychecks.

I know of the guys, who actually availed unemployment benefits on EAD, and yet got their GCs. At least sitting without regular paychecks is better than that.

Hi, Thanks for the reply, but she did not even know at that point about this provision. This was a kind of typo error, (05 to 04) .

This is to humbly request you to guide me.

I did AMIE in Computer Engg., from India and thereafter I underwent WES evaluation. It clearly stated that its equivalent to US Bachelors. On the same basis, I did my MBA from University of New Haven, CT USA. Now as I wan to file my H1B on the basis of my AMIE qualifiactions, what would be your wise advice?

I do not think so. I believe these are two separate issues and should not have any effect on the chances of your frnd securing visa.

My wife is currently applying for labor certification and I am planning to start my process for green card also. Is it advisable for both of us to apply for the green card? Is it considered duplication by the INS?

The reason for both of us starting the green card is that in case one of us has to move to a different job the other green card application might serve as a backup.

Please advise.

Dear Gurus,

I have applied for my I-485 in July 2007. A false DV case was filed against me by my ex-wife in January 2008 which was dismissed with prejudice in the court. I have all certified copies from court.

Now I got I-485 first interview letter from USCIS which is scheduled in Detroit.

Can I attend by myself or do I need to attend with a lawyer?

Could you guys advice me..

Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.

I have exact opposite case. My 140 was approved at TSC. Lawyers sent 485 to NSC. I asked they said its ok. Since they sent copy of 140 with 485. You can file anywhere.

I am wondering how do I help / sponsor to obtain US tourist visa (B2) for my young (say below 10 years) niece and nephew in India. Their parents (my brother and his wife) will not travel with them so they do not need a visa.

What is the procedure? What are the documents that I need to send from the US? What are the documents my brother in India need to provide?

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.

Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

Hi there,
I am going to apply H4 VISA for my spouse, but we don't have any marriage pictures. and the problem is I am here in USA and she is back home, and i can't go back home because of my project.
I came to know that pics are very important for H4 Visa.....Anybody have any suggestion...
