There is no special form to apply for AC21. It's a free form letter informing the USCIS that you would like to port your I-140 to a different employer.

Hello Attorneys,
My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?
Please advise.

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

You can even take an unpaid job/volunteer to keep you clear of the 90 days unemployed clause.
I didnt know that even the OPT rules have changed now. This is a mess.
Now OPT also you cant remain unemployed for more than 90 days. Now this OPT is becoming like another H1B.

Hi,
I filed my I-485 application with vermont and I live in WA, according to the instruction form , I765 should be sent to Nebraska
1. Where should I send the paper filing for EAD ot Nebraska or Vermont.
2. Should I make the check payable to USCIS or Department of Homeland security.

Can people post experiences on turnaround time for getting medical test documents back from the doctor? I have heard 2-3 days after initial appointment, but the doctor's offices I have called say 7-10 business days. Also, I have heard that some doctor's are faster than others. Is this true?

Covert status to B1/B2. That would just buy you 6 months at the max.

My I-140 (National waiver approved, no labor required, self-petition) is approved, both me and my wife are working on EAD. Have valid AP till Oct 2009. 485s filed July 2007.
Today, on 10th, my wife (dependent 485) got hard LUD, "request for evidence notice sent" is the update.

The RFE is for absence of child's name (my wife) on the birth certificate. They wanted another birth certificate, hospital document or religious record or civil authority record that shows her name and both the parents names. They gave us 90 days time.

I am on H1-B and my 6 years of H1B is going to complete on Sep so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I do have the copy of my I-140

Alex,
She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

I am an American and my wife is going though the green card application process. We recently received our interview date. Unfortunately, it was scheduled one day prior to our wedding ceremony which is out of the country. Our wedding is being presided over by the mayor of a fairly large city, with like 300 or so guests and at this point would be impossible to change. At the same time I hear that mixing international travel and rescheduling green card interviews is a risky thing.
We have an infopass scheduled in two weeks, and beyond the supporting documents of our flight and wedding information, is there anything else we should bring to prove that we can't possibly be at this interview? Is this something a lawyer might be able to handle better (like have more credibility)?
Anyone willing to give odds on us successfully changing our interview date?

Being infected by COTLS, I checked my status @USCIS.gov (as EAD filed, end of May (Paper based)@TSC- NO movement as of today.) I got a soft LUD on 7/13 on my already approved I-140 (approved mid of 2006).
I had earlier read a thread where people were talking about LUD on their cases dated 7/13/08. I was surprised as I am EB3-I.
Anybody has insight on this case? Any comments?
I will go take a chill pill as of now (to try to get rid of COLTS).
