My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

When you are working as fulltime employee for american client (not consultancy) then why are you worried?

Can someone point me to a resource that will allow me to quickly colate info on positive and negative bills for us. Specifically (right now) ones in the Senate.

Hi
I am currently on L2 visa with EAD and working for a company as direct employee. My wife is in L1. Both of our visas,I-94 and my EAD are valid till OCT-2010.
My wife has to go back to India as her current project is over.
My question is can a L2 visa holder with EAD stay back and continue working in U.S.A, after L1 has left the country ?.
Any information regarding this is highly appreciated.

My H-1B expires next year (after 6 years). I have been here 10 years (on J-1 and then H-1B visa). My employer isn't in a position to apply for Labor Certification, although they want to continue hiring me. I want to stay (no relatives here etc.). I know after one year, I can return on a new H-1B if my employer will petition again but it is messy and I want residency. I am from Britain. Help!!!

Hi,
I recently upgraded by I-140 to Premium processing. Soon after the filing of I-907, my status on USCIS status website changed from initial review to Acceptance. The message displayed is that my case has been rejected because of incorrect filing fees. I contacted my lawyer and he is confident that my upgrade was filed properly. He also told me that he has been observing same issue for several clients ,where USCIS website is displaying incorrect message. I am not sure what should be my next step. Is it something I should be worried about?
Is there some one with similar experience ?

Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

I need expert advice -

that I am using for my current employment with my current employer
1. If I get laid-off, how long can I stay in US without another job?
2. I understand that in order to maintain my eligibility to "port" to a new employer / sponsor under AC21, I should have another job in same or similar occupation. Till I find another job, am I allowed to do some part-time job in different occupation?
3. If new employer gives me the option to move permanently to its subsidiary in another country, what are the available option for me to continue with green card processing?
4. If after going out of the country , I want to come back in future before Green card approval, what will be the available options?

My EB3 RIR is filed on Feb 2005. Waiting for LC to clear. Also H1B expires on Jun 2007. Waiting for H1B extension for another 1 year.
I would like to change my job once I get my H1B extension.
1) Can I change my Job during my one year H1B extension when my LC is not cleared?
2) Can I use my current PD (Feb 2005) when my new Company process LC again through EB2 PERM?
3) From the new company, once I get LC through EB2 PERM, can I apply H1B extension for 3 years?

Also ppl whose applications have been transfered have not got any receipts.
About the 17th July, i think we should be atleast looking for minimum 15-20 business days.
I will request you to please concentrate on the September Rally. It will bring relief for all of us.

Here's another article discussing the embarrassment that is CNN's Lou Dobbs Tonight. I don't need to elaborate on that, but the more interesting part of this article is a discussion of why CNN is so reluctant to fire him. Apparently, it's more fear of Dobbs going to Fox and worry about Dobbs using his radio show to bash CNN. But is this really so valid? Dobbs' ratings are down 20% this year. Fired anchors jump networks all the time. Some do better at their new digs. Others fade in to further obscurity. And CNN is bashed daily both on Fox...

One thing is clear just lecturing members to go meet up with the lawmakers is NOT working. IV needs to come up with some fresh ideas, I mean, we all need to come up with new ideas.
Lets start brainstorming again. Here is a start
1. Some how IV meets with the president or his staff and requests visa recapture an interim fix. Ask for visa lottery numbers to be allocated to EB numbers for 3 years
Ask for relaxation in rules for changing jobs.
2. Run full page or a big advertisement in a national daily asking for the above. I am sure people will contribute if IV takes initiative.
3. Get USCIS working on our FOIA request asap. Complain to the president about it.
4. Legal action
