Hello gurus,
I have a few questions about my case.
I have a 3year degree in Bachelors of Science (Maths) and a 1 year degree in BS in Computer Information systems from Golden Gate University in (San Francisco, CA). However at the time of my GC filing, my lawyer advised me that i cannot file for EB2 but for EB3, since my bachelors degree does not evaluate to a 4 year US degree (based on the single source rule). So i had to file my I-140 in EB3.
Recently i read an article on murthy.com http://www.murthy.com/news/n_combdg.html this article clearly mentions that the person I-140 was denied by USCIS but the AAO overturned the case. I asked my lawyer about this, she says that even thought the person had two degree, they were from the same university, but from my understanding ethiraj college is an autonomous university.
I have a feeling my case is similar, what do you'll think i should do..

Is it having any advantage towards applying I-485 if getting married in US (H1B and other is on F1).

Canada gives 50% credit for stay in canada using legal visa, prior to obtaining PR towards citizenship.
Thats great in my book if US implements similar. I already accumulated enough stay.:p But I am only being selfish. :rolleyes:

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

I'm glad to see Immigration Voice weighing in on this one. On July 29, the National Review Online broke the story about a leaked USCIS memo entitled "Administrative Alternatives to Comprehensive Immigration Reform". Immediately, Senate Republicans went on the attack. Senator Charles Grassley(R-Iowa) did not hesitate to invoke the dreaded "A word": "This memo give credence to our concerns that the administration will go to great lengths to circumvent Congress and unilaterally execute a back door amnesty plan." A "back door amnesty plan"? Whoa! Now, wouldn't that be a great issue for the Republicans in the November elections? However, Senator Grassley must be hoping that people will not take the time...

I want to that till how much time is the petition valid , if I dont go for stamping.
Also , suppose my company withdraws the petition, so now till how much duration my cap number is valid?
Expiration date will be mentioned on I-797 approval notice
you will be counted only once against cap. and you can be on H1/L1 for total of 6 years (without a break) - ofcourse assumption is that you never file for a GC

Hi,
I am going back to India by next week. But my L1B extension is still pending (We applied for ext., before it expired and recieved RFE and responded. So as of now its more then 6 months from the date of I-94 expired and still my petition is in process).
My question is,
- while going back, do I need to show the copy of reciept in Port of Entry? (as I need to return my I-94 which is expired long back)
- Will it create any problem when I apply for extension again?
(My employer say, it shouldn't be a problem as I will have Approved/Denial notice which prove that I maintained legal status)
Or is it worth to wait here until I get the decision? (as I may cross 240 days by Jan, I am not sure whether the decision will come before that)...
Please adivce.

if filed I think your att. may use PD portability.
If not filed, don't see any reason why he can't straight use the LC of 2003.

I"m currently working for a TARP company and my I-94 date is Aug 2009. I still have 3 years left on my H1B.
I've got an offer from another bank (non-TARP) and they have filed for my H1 transfer.
a) Any idea what the wait times are these days?
b) Anybody seen problems with H1B transfers these days?
c) There might be a 1 week overlap (pay) between my current company and my future company. is that OK? e.g. My join date in the new company will be Feb 23rd and my notice date will be Feb 28th in my current company.
