Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

You can export the cube with only the outlines and then export the cube without the outlines and just the fill. Incorporate both animations into Flash, and you should be able to manipulate them both as you choose.

Hi,

I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.

I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.

Can anybody give me advice or have some experiece in filing H1 or transfer H1?

send them the business week article. In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and bothered to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.

Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

Hi,

My wife has received the ASC notice of biometric appointment. But I did not. She filed as dependent of my concurrent I-140 + I-485 case. I am wondering if there is anything wrong. Should we receive the notice together? Or it is normal to have seperate appointments? Then how long could be the interval between the notices? Anyone in the same situation before? Could I find it out by Infopass appointment?

When i was in India, my company applied for H1B visa. In the meantime I got married and came to US on H4 visa. After a month, my H1B was approved. Now, my company is planning to apply for a change of status. I have the following queries:
1. Do we have to fill in I 539 form or I 129 form
2. How long is the processing time?
3. Will i be eligible to work from Oct 1st, 2007 even though the change of status case is in process? Or should i wait till its been approved?

Hello.
I will be needing a new re-entry permit(i-131) while renewing my green card and i was wondering if it was possible.

I am going to study back in my home country for 4yrs.
first 2yrs(2010-2012), i am going back with reentry permit.
after 2yrs(2012), i am going back to USA for 6months to renew my green card(going to expire in 2012) and reapply for a new reentry permit.
If i wont have time to get my new green card, i am possibly thinking of going back to my home country for 5 months and going back to USA for 2 wks (to retain green card status) and again, going back to my homecountry for 3 months.
Would going back and forth to my homecountry and USA will affect me from losing my green card?

Any advise will be helpful. Thank you!

I am on H1B all these days and now my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)Can my employer revoke the I140, considering that its already been more than 180days since approved.

Note: I have my 485 pending and 140 approved in April 2008 and I am a July 2007 filer with a priority date of June 24th 2007.

Hi,

I believe someone already asked a similar question but I just want to describe my exact situation:

- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B

With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?

I'll greatly appreciate any comments.

I received a RFE of my I485, and was asked to declare my self-employment since Dec,31, 2006. I have been engaged in Market America Direct Sell business part-time since August 26, 2005, and have claimed buinsess lost in my tax return since 2005. In 2006, I got a 1099 form that showed $600 income from Market America. After that I didn't have any income from the business.

My question is if I am self-employment. If so, do you have any way to resolve this issue?

My last entry into USA is 07/05/2008, but the I-94 was not replaced at Niagara Falls port. The last entry date on my passport is still Dec, 31, 2006.

My EAD start date is 7/31/2008.

I am looking for an Attorney who is an expert at this case to reply my RFE and resolve my pronblem.

My one extension has been filed. My question is:

I need advise from gurus.

i have taken an appointment at the chennai consulate on aug 24th.
I have the old h1b approval valid till October 3 2006 to October 4 2007.
I have the new h1b approval valid till from october 5 2007 to october 4 2008.

I have taken the appointment for the new h1b approval. my question is:

since its valid from october 5 2007, can i come back to USA before october 5 2007? Do they give the visa stamp validity all the way from october 6 2006 to october 4 2008 since i have both the h1b approvals?

how does it work? we have to use only h1b approval? can somebody let me know they had the same situation?

Let me make this suggestion, instead of trying to organize statewide, organize aroound each of the senators offices in a state. In this way you can get more people to join as they ahve to travel only short distances to meet, and you can also make more of an impact by giving the senator input from multiple local offices instead of one central office.

I just met and spoke to Sen Schumers office locally and explained our problems, and showed our presentation, they said they will convey it to the senator. I urge you to do the same

Hi

I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.

I have 2 questions here.

1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.

2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).

Please advice, I will really appreciate your suggestions on this ASAP.

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?

I will appreciate any advice.

I wanted your advice. I filed for my 485. Then hit retro. Got married. Now got current in June VB. Want to apply wifes 485. EB2 India PD 15 March 04. Initially lawyer said he would do everything in one fees. Now he says he will charge 1000 dollars more since he is filing for wifes separately. I was wondering whether to do it myself. Is it advisable? Has anyone done it succesfully? If so what do you put on top of your application so that USCIS knows I am filing for derivative and my PD is current and so they wont reject the docs? For the marriage, do you have any evidence of the marriage happening (like you can get something from the priest). You then go to the local registrar of marriage and show him the evidence. He will register the marriage and give you an official certificate. Your relatives in your home country should help you with this procedure.

For the DOB, look for FAQ on affidavits. Every immigration website has info on this.

Almost 22 week past, No response From Mumbai Consulate

Interview Date - 13-Feb-2009
Purpose - H1B Visa Stamping(VISA Approval in 2008 before had F1 Visa)

Interview - VO Asked me few Questions and then asked me to show your company's Wages report and your consultacy and client where u worked agreement letter. I have given him both the docs. and Vo kept with him and gave me 221G Yellow letter which mentioned your docs. are in administrative processing and didn't mentioned any time frame.

After my Employer and i frequently sent emails and faxes to mumbai consulate but no response yet.

Anybody Knows what i have to do. Please advice me further .

once 140 is approved, one can port the PD. Doesn't matter whether it was LC SUB or not. My personal understanding, check with a lawyer.

However this practice is long gone (discontinued since second quarter of 2007) and no more LC SUB is allowed.

I am wondering, I assume that you must have done this prior to second quarter of 2007, then you may have also filed 485 based on this 140.

Hello,

I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.

I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

Is there only one member in the IL chapter? I am sure we have several IV members from this state and nobody has responded. It is sad to see such response from members. IN order to get anything done, we all have to pitch in and help out.

Yesterday I received email that card production ordered and today it says I have to go through some ADIT processing. Does this mean that they require some additional documents for processing or verification. The exact message is as below...

"On August 6, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.
"

Can anyone please tell me what this means.
